1. Introduction

The Promotion of Access to Information Act, No. 2 of 2000 ("the Act") was enacted on 3 February 2000, giving effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights.

3. The ACT and Section 10 Guide

The ACT grants a requester access to records of a private body, if the record is required for the exercise or protection of any rights. If a public body lodges a request, the public body must be acting in the public interest.

Requests in terms of the ACT shall be made in accordance with the prescribed procedures, at the rates provided. The forms and tariff are dealt with in paragraphs 6 and 7 of the Act.

4. Applicable Legislation

Where applicable to our operations, information is also available in terms of certain provisions of the following statutes:

  • Electronic Communications and Transactions Act 25 of 2002
  • Consumer Protection Act 68 of 2008
  • Protection of Personal Information Act 4 of 2013
  • Copyright Act 98 of 1978

5. Schedule of Records

We hold the following categories of information:

  • Internal Records: Financial records, operational records, intellectual property, marketing records.
  • Personnel Records: Employment contracts, disciplinary records, salary records, leave records.
  • Customer Records: Customer details, transaction history, correspondence.

6. Request Process

To request access to a record, please use the prescribed form defined in the Act. The form must be submitted to the Information Officer at the email address provided above.

The requester must provide sufficient detail on the request form to enable the Information Officer to identify the record and the requester. The requester should also indicate which form of access is required and specify a postal address or fax number in the Republic.
